How Do I File an Uncontested Divorce?

You must meet California residency requirements to file an uncontested divorce. Either spouse must have lived in California for the last six months before the divorce petition is filed. In addition, one spouse must have lived at minimum three months in the county in which he/she plans to file for divorce during this time.

The following forms must be completed and filed with the court to start the uncontested divorce process:

  2. FL 110 Summons (Family Law)
  3. FL 105 Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (if you have minor children)
